Lease Addendum Updated 5/18/24
1: Move-out Date:
Lessee agrees to vacate the premise by the last day of the lease before noon. (ADD TO LEASE PAGE 1 AFTER "TERMINATING ON") _______________
Lessee must ensure that the apartment is empty and cleaned by this time. Upon inspection of the apartment, should the Lessor find it in an unsatisfactory condition, professional cleaning services may be hired and the lessee will be forfeit the prepaid $450 key/cleaning fee that is part of last month's rent.
Cleaning includes:
-Kitchen: Removal of all food items from the refrigerator/freezer and cabinets. Cleaning/defrosting the refrigerator/ freezer, and wiping cabinets. Cleaning the dishwasher. Cleaning the oven/stove.
-Bathroom: Cleaning/disinfecting the tub/shower. Cleaning/disinfecting the toilet/sinks.
-Windows: Cleaning the glass and woodwork.
-Walls: REPAIR AND PAINT WHERE REQUIRED.
-Overall: Vacuuming, sweeping, mopping of all floors. Removal of trash from the apartment. Removal of all furniture, AC units, and personal items. If an item was left in the apartment by a prior tenant and the lessee does not ask to have it removed, the lessee is responsible to remove the item at lease end. All blinds, window treatments, screens, that are up at move-in are apartment fixtures and must remain in place and proper working condition. Use photos to verify/discuss move-in questions.
Repair labor, including administrative time, cost is billed at $75/hour.

2: Rent Payment: Rent is due and payable on the FIRST of each month in advance without exception. If received after the 10th of the month, a $35.00 late charge will be assessed. Should your bank return your check as unpaid, for any reason, you will be assessed a handling charge of $35.00. The rental payment will be made each month with ONE PAYMENT, check or money transfer, wire, etc.
3: Lost or unreturned door key: A lost or unreturned door key will result in forfeit of the prepaid $450.00 deposit from the last month's rent. At termination of tenancy, leave doors unlocked and all keys on kitchen counter.
4: Lock out: Lessee will pay the locksmith if the locksmith is called for a lockout. Lock change: Lessee is responsible for returning locks to master system should they be changed by the tenant or as the result of the tenant losing any keys to the unit or the building.
5: Breach of Contract: In the event the lessee wants to terminate this lease prior to the expiration of the lease term, the lessee is responsible for any rent payments until the premises are re-rented. The lessee will remain responsible for all loss of rent incurred by the landlord through the expiration date of the lease, together will all brokerage fees, legal fees and expenses and costs incurred by the landlord as a result of such breach and to collect any amounts owed the landlord. If the lessee signed a two-year lease in exchange for the lessor paying the broker's fee, the lessee agrees to pay the broker's fee to the lessor the same day the lessee informs the lessor that they wish to terminate the lease prior to the 24 month lease end.
6: Plumbing Clogs: Lessee is responsible for fixing/correcting clogged sinks, toilets, drains, and disposal repair and/or replacement. Lessee is responsible for payment of any related bills/invoices." The lessee is responsible for IMMEDIATELY notifying the lessor about plumbing leaks, or running water in any/all malfunctioning plumbing fixtures. If the lessee's failure to notify the lessor IMMEDIATELY and there is an incremental increase in the water bill (based on the prior month's daily average vs the "leak period" month's daily average), the lessee will be invoiced and pay for the incremental increase in the water bill, based on the prior month's daily average vs the "leak period" month's daily average.

7: HEAT and WATER are provided by the Lessor.
EXCEPTION: Supplemental heating systems in apartment ____, provided in addition to what is already present or available to complete or enhance the building heating system, are paid for by the lessee via the lessee's monthly electric bill.

8: Occupancy: Occupancy is limited to the lease-named lessee/lessees only.
9: Access: Tenants agree to allow the Lessor or its designated representative entry to the apartment between 8 AM and 5 PM for any valid purpose (i.e.: periodic inspections, maintenance and repairs) with 4-hour telephone notice and/or without tenants being present. In an emergency the tenant allows lessor access immediately upon notification even without lessee response (example: plumbing leak). Real estate brokers will give 2-hour or more notice to show the apartment to prospective new tenants. Having been given 2-hour notice, tenants agree to allow real estate brokers and prospective tenants entry to the apartment between 9 AM and 6 PM Monday thru Friday and between 10am and 4pm Saturday and Sunday. Tenants agree to their email and phone number being posted on bostonbrookineapartments.com so real estate brokers can contact them for showings and listing photos.

10: Insurance: Tenants are responsible for insuring their personal belongings.
11: Move In: If the prior tenant fails to clean the apartment or make expected repairs, any such cleaning or work may have to be done after Lessee takes occupancy. This clause is the correction of the deletions in the #8 lease clause. Lessee Initials_____________________
12: Trash: Tenants are responsible for trash removal. No trash shall be left in hallways. Trash or any other personal property must be maintained within the confines of the apartment. Trash should be put out on after 5 PM the night before the City pickup or in the AM before pickup on the designated day. If the Lessee is responsible for ISD trash related violations, identified by an ISD inspector, the Lessee will pay the fine associated with the violation.

13: No storage in the basement or any common area.

15: No access to roof is allowed.

18: The tax clause in the lease will be active and applied. The tax charge is sent out in January/February for payment within 7 days. The base tax fiscal year and the billing tax fiscal year are calculated as if they are concurrent with the 12-month lease period to simplify calculation.

19. BROKERS' FEE: If the lessee agrees to a two lease in return for the lessor paying the brokerage fee and the lessee fails to stay in and pay rent for the full lease term, the lessee agrees to repay the brokerage fee to the lessor.
20. All (phone, text and email) non-emergency communication between 8am and 4pm Monday thru Friday. Lessee agrees to communicate via voice telephone call.

21. No smoking, tobacco and all non-tobacco items.
22. Lease renewal notice will be sent 4 and a half months before the lease end date. The lessee will inform the lessor the lease renewal decision 120 days, 4 months before the lease ends. Failure to answer by the 4 month deadline is affirmation by the lessee that the lease will end and the lessee will vacate at lease end.
23. Smoke detectors: The lessee is responsible for proper operation and maintenance of all smoke detectors including batteries. If the smoke detector needs to be replaced (failure to operate for a reason other than battery replacement), the lessee is responsible for telling the lessor upon noticing the smoke detector's failure.
24. No apartment property or fixtures, such as appliances, any electrical item, windows, screens, can be removed from the apartment. Window air conditioning units will be removed from windows from November 1st - April 1st.

25. The lessee will operate all apartment property, fixtures, and systems according to manufacturers’ specifications or the lessor’s verbal instructions (google search is an instructional source).
Incident examples:
-Shutting off a toilet water supply so that the toilet will not overflow.
-Closing windows and storm windows (Real incident: A tenant left the storm window open during a rainstorm. Two apartments below had water damage.)

26. No pets.
27. Reporting:Lessee will report any "apartment / common area" damage or problem condition (examples: paint issue, grout issue, broken window blind, broken washer/dryer, improper trash placement) with text photo.
Building maintenance or a 3rd party will repair the problem. If the lessee initiates a repair without lessor consent, the lessee agrees to pay for any/all damage.
Examples:
-A closet door sticks so the lessee breaks the door.
-A kitchen cabinet door is loose. Lessee fails to report, the door damages the cabinet.

28. Forwarding address: 14 days prior to lease end, the lessee will provide a new residential address for the refundable $450 portion of the last month's rent (whole or partial as determined within 30 days after lease end) mailing return when the apartment is left clean and the keys are returned. This address will be the upcoming residence only, not a 3rd party address or commercial address. Failure to provide this mailing information is agreement to forfeit the deposit return.
29. Real estate broker: Before lease date commencement the lessee will communicate with the real estate broker. After lease commencement the lessee will communicate with the lessor. The real estate broker will draft the lease (with lessor draft review), check the pre-move-in apartment condition, and coordinate key delivery and move-in. Any apartment details prior to move in, such as apartment dimensions, etc., the broker will provide to the lessee.
30. Partial Lessee Change : Requests for lease changes for any reason (such as a replacement tenant in an apartment with multiple lessees) will cost $150, and require new lease documentation and a new signed lease.
31. The lessor provides one key set. A lessee requesting additional keys can purchase them from the lessor’s locksmith at the lessee’s expense, and pay the locksmith directly. If the lessee fails to return all keys at lease end, the lessee agrees to pay for the apt lock change.
